Pour les moins de 300 salari\u00e9s, la BDES peut \u00eatre sur papier ou \u00e9lectronique.<\/p>\n<p>L&rsquo;article R2312-5 pr\u00e9voit clairement, sauf dispositions contraires, que le d\u00e9lai de consultation du CSE court \u00e0 compter de l&rsquo;information par l&#8217;employeur de la mise \u00e0 disposition dans la BDES des informations pr\u00e9vues par le code du travail pour ladite consultation.<\/p>\n<p>Les articles R2312-8 (moins de 300 salari\u00e9s) et R2312-9 (au moins 300 salari\u00e9s) portent sur le contenu de la BDES (\u00e0 d\u00e9faut d&rsquo;accord, cf. ci-dessus). Attention : ils contiennent des modifications par rapport \u00e0 ce qui existait jusqu&rsquo;\u00e0 pr\u00e9sent. A noter que pour les entreprises d&rsquo;au moins 300 salari\u00e9s, le d\u00e9cret r\u00e9pare une \u00ab\u00a0omission\u00a0\u00bb de la loi de juin 2013 : les indicateurs relatifs \u00e0 la repr\u00e9sentation du personnel r\u00e9apparaissent.<\/p>\n<p>Au global ce nouveau d\u00e9cret d&rsquo;application (parmi 24 autres&#8230;) suite aux ordonnances de septembre dernier, pr\u00e9cise, clarifie et conforte l&rsquo;obligation de mise en oeuvre et d&rsquo;alimentation de la BDES.
